I want to thank the Malaysian Franchise Association for inviting me again to speak my mind on the overview of the law on franchise in Malaysia in Johor Bahru on the 9th January 2021.

The Franchise Act 1998 went through two major amendments in 2012 and 2020. The amendments make franchising an offence for non compliance in some mandatory actions such as section 18 on franchise agreement, section 15 on compulsory practices to deliver the franchise agreement and documents within 10 days, section 16 on annual reports, franchise registrations for all stake holders in section 6, 6A and 6B, the use of the word franchise in section 39A and the other sections and making it more strict to safeguard trade secrets and confidentiality under section 26 of the franchise system.
